Terms of Service
These Terms of Service ("Terms") govern the use of AskAniela at https://askaniela.com, the API and related documentation (the "Service"), provided by IBB MEDIA Roman Rozenberger, Kargowska 12, 66-133 Klenica, Poland, tax ID (NIP) 929 179 66 80, REGON 363374908 ("we", "us"). The English version is binding; translations are for convenience.
1. Who may use the Service
- The Service is offered to businesses ("Business Customers") and to consumers ("Consumers"). A Consumer is a natural person acting for purposes outside their trade, business or profession. Provisions marked "Consumers" apply only to Consumers; nothing in these Terms limits rights that Consumers have under mandatory law.
- You must be at least 18 years old. If you accept these Terms on behalf of an organisation, you confirm that you are authorised to bind it; the organisation is then the customer.
2. Beta
Parts of the Service are marked as beta. Beta features may change, be limited or be withdrawn at any time, may be less reliable and are provided without any service level. We will give reasonable notice before withdrawing a paid feature you have already paid for, or restore the corresponding amount to your balance.
3. What the Service does - and does not do
- The Service checks web pages against rules derived from Google's public spam policies and the Search Quality Rater Guidelines. For each rule a language model answers 0 or 1; our code computes all scores.
- Results are automated estimates, not facts, legal opinions or decisions of Google. Raw scores are a ranking and become probabilities only after calibration. The Service can be wrong in both directions.
- We do not guarantee any outcome in Google Search (rankings, indexing, traffic, manual actions or their removal). Do not rely on results alone for legal, financial or business decisions.
- AskAniela is not affiliated with, endorsed by or sponsored by Google LLC. Google is a trademark of Google LLC, used only to describe the public documents our rules refer to.
4. Accounts and organisations
- You must give accurate registration data and keep your password and API keys confidential. Activity under your account or keys is treated as yours.
- Accounts belong to organisations. The organisation owner manages members, projects, keys and the balance and is responsible for members' compliance with these Terms. The balance belongs to the organisation, not to an individual member.
- You may close your account at any time. Closing an account does not refund the balance (see the Billing & Refund Policy).
5. Prices, plans and payment
- Use of the Service is charged in US dollars. The price of each operation comes from the published, versioned price list and is shown before a paid operation starts.
- Plans include a monthly USD allowance that does not carry over. Pay-as-you-go balance (top-ups) is valid for 12 months from purchase. Prices, taxes and the payment provider are shown at checkout.
- Purchased balance is non-refundable and cannot be paid out in cash, except where mandatory law requires otherwise. Details, including what happens after system errors and plan changes, are in the Billing & Refund Policy, which forms part of these Terms.
- Consumers - right of withdrawal. The Service is a digital service supplied immediately. At checkout we ask for your express consent to immediate performance and your acknowledgement that you thereby lose the 14-day right of withdrawal once performance has begun. Without that consent, you keep the right of withdrawal for the unused balance, as described in the Billing & Refund Policy.
6. Acceptable use
You may analyse only pages you own or are authorised to analyse. You must comply with the Acceptable Use Policy, which forms part of these Terms. In particular you must not use the Service to harm competitors or third parties, nor to scrape or crawl third-party sites through us.
7. Your content and our intellectual property
- You keep all rights to content you submit. You grant us a licence limited to processing it to provide the Service, for the retention periods in the Privacy Policy.
- You may use reports produced for you without restriction for your own and your clients' purposes, provided you do not present them as statements of Google.
- The Service, its software, rule catalogue, prompts, calibration and documentation are protected by intellectual property rights and remain ours. You must not copy, reverse engineer or build a competing rule set from them except as permitted by mandatory law.
- Feedback you give (for example "wrong result" reports) may be used to improve the Service.
8. Availability and changes to the Service
We aim for high availability but do not guarantee it unless agreed in writing. We may change the Service, the rule catalogue and models; changes that significantly reduce paid functionality will be notified in advance.
9. Suspension and termination
- We may suspend or restrict access, with notice where reasonable, if you breach these Terms or the Acceptable Use Policy, if your use endangers the Service or others, or if required by law.
- Serious or repeated breaches allow us to terminate the account. Balance forfeited because of a breach are not refunded, unless mandatory law provides otherwise.
- Business Customers and Consumers may terminate at any time by closing the account.
10. Liability
- Business Customers: to the extent permitted by law, our total liability arising from the Service in any 12-month period is limited to the amount you paid us in that period, and we are not liable for lost profits, lost revenue, lost data beyond our backups, or indirect damage. The Service is provided "as is".
- Consumers: we are liable under mandatory law, including for non-conformity of digital content or services. The limitations in point 1 do not apply to Consumers.
- Nothing limits liability for intentional damage, gross negligence (Business Customers: wilful misconduct), death or personal injury, or any liability that cannot be limited by law.
11. Complaints
Send complaints to roman@rozenberger.com. We reply within 14 days. Consumers may also use out-of-court complaint and redress procedures, for example the consumer ombudsman (rzecznik konsumentów) or the Voivodeship Inspectorate of Trade Inspection.
12. Changes to these Terms
We may change these Terms for important reasons (law, security, changes to the Service). We notify you at least 14 days in advance by e-mail or in the panel; you will be asked to accept the new version. If you do not accept, you may close your account before the change takes effect; Consumers then receive a refund of the unused balance bought under the previous version where mandatory law requires it.
13. Governing law and courts
- These Terms are governed by Polish law and applicable EU law.
- Business Customers: disputes go to the court competent for our registered office.
- Consumers: you keep the protection of mandatory provisions of the law of your country of habitual residence and may bring proceedings in the courts competent under EU law.
